The Chinese Communist Party is the party in power .The Chinese Communist Party抯 general plan of leading people governing the country is different from other parties, which determines that its methods of administration are different from others. The 15th Party Congress stated that administering the country according to law is the basic general plan of leading people governing the country, and the 2nd meeting of the 9th National Peoples Congress added the notion of?The Peoples Republic of China administer the country according to law and try to build a legal stale of socialism.?as constitutional amendment into the constitution. This embleniafized that the basic general plan of the Chinese Communist Party has materially been changed, which will inevitably lead to great transform of the administrative mode. This dissertation tries hard to apply the theory of the Marxist parties and the Chinese Communist Party basic academic viewpoint of the theory of construction, the political science, the science of law and other social sciences, adopts the methods of class analysis, the methods of the dialectical materialism together with the historical materialism, the methods of comparative study and the methods of linking historical works, on the basis of absorbing and using the existing research findings of these years analyzes the problem of the Chinese Communist Party抯 basic administrative mode and puts forward the proposition of the Chinese Communist Party抯 fundamental administrative mode on condition of administenng the country according to law .It also expatiates on the fundamental connotation , the theoretic value and the practical significance of the Chinese Communist Party administrating according to law. it demonstrates as weLl as analyzes that the Chinese Communist Party has to reform its administrative mode in order to put the concept of administrating according to law into practice, and which is the principal measure and the fundamental consideration that the party in power and the country should take. The dissertation includes three chapters as follows. The first chapter expatiates summarily on that administrating according to law is the Chinese Communist Party抯 fundamental administrative mode on condition of administering the country according to law .It puts forward the connotation and the basic class of the administrative mode of the party in power, and analyzes the key factors that determine the administrative mode of the party in power of every country, and states that administrating according to law is the common administrative mode of the party in power in every legal staie.It summarizes the connotation of administrating according to law by the Chinese Communist party and expatiates on its sigmficance. The second chapter emphatically discusses the problem that the Chinese Comnumist Party has to transform the traditional administrative mode to the administrative mode according to law in order to put the concept of administrating according to law into practice, and suggests that the patty in power should change from the form of administrating by the party to the form of administrating by the countiy and should change from administrating by policy to administrating by the county laws and should change from ruling by men to ruling by laws.
