| Trust originated from British "USE" in the 13th Century. In its more seven centuries' history, trust has formed diversified operation patterns in the Western developed countries. It has become one of the most important branches in finance, together with bank, insurance and securities. In China, trust has been introduced for about 90 years. Actually, since 1979, trust has gotten its authentic development just only for 25 years. But in 25 years, Trust industry of China has been adjusted for five times. People think that trust is closely linked with risk and violation. After "Trust law", "Administer method of trust and investment corporation", and "Temporarily Administer method on gather fund of trust and investment corporation" published in 2002, trust has its law frame for development. But institutional bounds still exist in trust industry. Facing trust' history and reality , we have to think : trust industry is born bad child? How to develop our country' trust ? So, we first introduced trust's feature, and review trust's history, analyze trust's institutional change by institutional economics' theories ,and arrive the conclusion that the ignorance of institutional construction made trust industry of China develop very slowly. Further, from demand and supply we investigate trust' realities and propose some policy suggestion to improve our trust industry's institutional environment. On the other hand, trust and investment corporation should put its emphasis on financial innovation and make strategy choices to comply to the international finance trend.Chapter â… Introduction At first, I introduce the topic of my thesis, interrelated documents and the way, the method , the purpose and the innovation of my research.Chapter â…¡ The natural characteristic of trust and comparative study on trust's development I introduce the trust's definition and origin, and expound trust's nature characteristic: Separation of ownership and beneficial rights; Independence of trust property; Limited liability; Continuity in the management of trust. Using the historic way and horizontal compare way, I analysis trust's evolution of the Western developed countries, summarize the influencing factors of trust's development, and foreshadow the next chapter of trust institution' introduce in China.Chapter â…¢ The historic evolution, business feature and development evaluation of China's trust industry Beginning with the introduction of trust's history and business development in China, I emphasis to describe trust's history after the economics reform. Through describing the background, the course and the effect of the five big adjustment, I think that China's institution change has distinct system character. Trust is the outcome of economic reform, not of the market demand. So the trust industry of China has some problems, such as the dissimilation of trust's business, the shortage of capital source and the single scope of corporation business.Chapter â…£ Analysis on trust institutional evolution on the angle of institution change. From the angle of institutional economics, I analysis the institution change of china's trust. By using games and agency theory, I arrive the conclusion that locally-administered state character of china's trust and investment corporation is the basic institution defect, and imperfect supervision system make trust and investment corporation choice to breach the law because of violation income exceeding violation cost.Chapter â…¤ Investigation of trust' institution defect in China I explain the current trust's institution obstruction in China from the institution demand and supply. At present, though trust's environment has been changed with the development of economy, the institution supply of trust's industry can't satisfy the market institution demand.
