Study Of Russian Private International Law Of Conflict Of Laws

Russia's private international law had much effect on the system of the China's private international law at the beginning of establishment of China. With the change of Russia' society, politics and economy, Russia's private international law has shown new characters. From the point of view of conflict of laws ,the article, which bases on writings, cases , laws and regulations, discusses and researches Russia's private international law, on the guide of the recent development of Russia's private international law.The article consists of 10 chapters. Chapter one sets forth wholly characters, sources ,objects and systems of Russia's private international law in different times. Chapter two analyzes the ways which ascertain Lex Causae of legal status of natural persons and legal persons. Chapter three discusses status quo of theory and legislation of Russia's conflict of laws on the outset of definitions ,systems and sources of Russia's conflict of laws . Chapter four and Chapter five debate problems rising of application of Russia's conflict of laws, in the part, the author discusses nine questions of renvoi , preliminary question ,evasion of law, classification, reciprocity and retaliation, proof of law, application of national law with multi-legal regions, reserve of public order, mandatory rules, all of which have been argued but had positive meaning. Chapter six to Chapter ten is the part which regulates specific fields, the author chooses contract, non-contract, family, succession and labor ,then discusses general and specific questions of choice of law in various fields respectively. The last chapter generalizes characters of recent development of Russia's private international law and some existing questions on the basis of summarization of the article.
