Economic Rights Trading System Research

The thesis, adopting the perspectives of legal history, philosophy of law, legal economics, legal theoies and comparative jurisprudence; as well as the research method of historical analysis, analysis of institutional economics, comparative analysis and positivistic analysis, is trying to probe the justice and rationality of Exchange of Property Rights Involved in Copyright (hereafter refer to as EPRC), and exploies some theoretical issues, such as the subject and object system on EPRC, the exchange pattern and the limitation to exchange. By reflection and probe, the author attempts to expound the legal spirit of EPRC in China and to propose the material resolution plan considering the practice and defect of EPRC in China. The part of introduction in the thesis mainly dissects about the motive for this writing, the value of research, the tenet of the topic selection, the thinking way of research and main content, and the research methods in the thesis. The main body of this thesis comprises six chapters:Chapter one:"A Summarization of EPRC System". This part stresses on the motive for this problem. By a thorough analysis on the connotation of EPRC system, it anatomizes the difficulties in the EPRC research system both on the aspects of theory and practice, and defines dictions relating to EPRC preparing for the further dissertation on EPRC followed by.Chapter Two:"Justice of EPRC". This part, cutting in from the nature of the property rights involved in copyright and cluing on whether or not it possesses the nature of commodity, from the angle of economics, analyzes the costs of forming the property rights involved in copyright, exchange cost, protection cost and the feasibility of achieving the interest by exchange.
