The concept of environmental rights was developed in 1960s with the damage to human being by the environment crisis due to the fast development of the economy. The characteristics of the global environment crisis are the worldwide environmental damages to human being. The environment problem features in the environment pollution and ecological destruction. In fact, it is the increasing contradiction and conflict between human and the nature. The contradiction and conflict threaten the survival and development of human being. The economic background emerged with environmental rights is the global environment pollution, resource shortage and ecological destruction caused by the development and global expansion of capitalism after the Industrial Revolution. The theoretical background is market failure and government failure theory, public trust theory, sustainable development theory and intergenerational equity theory. Therefore, environmental rights theory has once become the hot point of rights research in western countries and the international community. Over 40 years'development, environmental rights have gradually become a common concept in international and domestic laws.It has been over 20 years'history till now since the research of environmental rights in our country began in 1980s.
