The present education in China is situated under the background of social system's transformation and global education's reform, and is facing many challenges from marketization, globalization to information. As the bridgehead of education's reform and the leading swan of knowledge's innovation, the institution of higher learning is in the front of education's development and reform. However, it shoulders so much expectation of people and bears so much social functions owing to its assembly of intellectuals, knowledge and information, so it is hard to run forward. Simultaneously, it is the epitome of outer society to some extents, where there are struggles of powers and manifestation of individual rights. Nowadays, the administrating mode of the institution of higher learning is urgently raised on the schedule when facing the severe social problems of equality of higher education, industrialization of education, lawsuits involvement of higher education. According to such circumstances, the rule of law to institutions of higher learning becomes the rational choice of their administrating mode and practical solution to solve the problems.
