Corporate Crime

Along with the establishment of market economy and the rapid economic development, the crime rate has increased greatly in the economic field. As an important type of economic organization of the modern time, the same time corporations, driven by their profit-pursuing nature, bring positive effects to the society, they also show some anti-society characters and characters of such are becoming more and more prominent. For this reason, the study on corporate crime appears very important, and this is also one of the meanings for writing this paper.This paper is not intended to summarize and analyze some crimes whose subjects are corporations, but to extract corporate crime wholly out of organizational crimes and study them. It will examine first the general nature of corporations, and then, through grasping the special features of corporate crime which are decided by their nature, choose several typical problems to study comparatively, from the angle of the comparative study on US and Chinese corporate crime. It will focus on the comparative study of the corporate crime concepts, the constitutive elements of a corporate crime, the corporate criminal liability, the punishment system, legislative improvement and so on. Its main purpose is to analyze relevant issues in American criminal laws and discuss what can be absorbed by Chinese criminal laws.
