| Nowadays, the system of bail pending trial with restricted liberty of moving in China is highlighted in the field of criminal justice. As an important compulsive measure, bail pending trial with restricted liberty of moving plays a significant role in safeguarding the human rights of criminal procedure. Due to some deficiencies in the system of bail pending trial with restricted liberty of moving, the application rate of this measure is low, and the situation of illegally prolonged custody is serious. In western countries, bail is regarded as one of the alternative measures for custody, which aims at restraining the state power and realizing the procedural justice. Comparatively, the specific design of the bail system is much sounder so that it plays an important role both in safeguarding human rights and in saving judicial resources.The dissertation makes a detailed discussion on the bail system in civil law system and common law system and deeply analyzes and studies the current problems with the system of bail pending trial with restricted liberty of moving in China.
