In the context of the development of globalization, national sovereignty transference has become a realistic and important issue. On the base of using the existing research production concerning national sovereignty transference at home and abroad, this dissertation put forward national sovereignty transference with self-determination and finity as the basic paradigm to deal with the national sovereignty issue, and applies the Marxist standpoint, viewpoint and method studies the issue creatively and foreseeingly.The dissertation is composed of nine chapters(ex the introduction and epilogue). The introduction mainly introduces the reasons for selecting this theme, the putting forward of national sovereignty transference with self-determination and finity as the basic paradigm to deal with the national sovereignty issue, rounds up the research status quo of national sovereignty transference, illuminates the grand significance of research and makes a brief explanation for the research starting point, related notions, the train of the thoughts and content of the full text.Chapter one mainly expounds the challenge posed by the trend of globalization on national sovereignty. The paper firstly combs the notion of national sovereignty and its development and considers that sovereignty is a historical and political category and is a process in which people constantly understand and practise it. Then, the paper analyses the concept of globalization and the manifestation of the challenge posed by the trend of globalization on national sovereignty and sums up that globalization is a multidimensional and dynamic developmental process which restricts, erodes, partitions and even transfers the sovereignty of nation-states.Chapter two mainly deals with the putting forward of the issue and the concept of the national sovereignty transference with self-determination and finity and its inchoate practice. The paper firstly analyses the changes derived from the national sovereignty in the trend of globalization, and as one of the changes, the issue of sovereignty transference was brought forward and emerged in the study ken of international relations. Secondly, this paper defines the concept of sovereignty transference from the perspective of sovereignty noumenon and holds that sovereignty should be divided into sovereignty identity and sovereignty power and function, the sovereignty transference is not the former but the latter. Lastly, the paper researches the preliminary attempt and inchoate practice of national sovereignty transference and holds that the restrictions on the national power of warring embodied in the collective security institutions of League of Nations and UN are the preliminary attempt of national sovereignty transference and the start and development of the integration of Europe is the inchoate practice of national sovereignty transference.Chapter three places the emphasis on the analysis of the reasons for the necessity and possibility of national sovereignty transference with self-determination and finity."No reasons, no results."In the context of the development of globalization, the interdependence relations of interstates, the composing of national interests and the changes in the way of acquiring national interests make states confine the power of themselves and it is reasonable and necessary to transfer some of the national sovereignty. Meanwhile, under the international circumstances influenced by the development of globalization, the mingling of national, regional and international interests, the separating of the proprietary and the executive right of sovereignty, the enhanced coherence of domestic and foreign affairs, the improvement of democratization degree of international relations, and so on, provide various necessary conditions within and outside the states for the realistic probability of national sovereignty transference.Linking with the reality of international relations, chapter four lays the emphasis on summing up the embodied content and transference forms of national sovereignty transference with self-determination and finity. At the operational level, sovereignty can be considered as an aggregate composed of essential factors of sovereignty, such as political sovereignty, economic sovereignty, cultural sovereignty, environmental sovereignty and safety sovereignty, etc. In the contemporary international relations, the content of sovereignty transference made by states involves not only the traditional high politics(politics, military affairs and national safety, etc) but also the so-called low politics(economics, culture and environment, etc). Sovereignty transference must be carried through certain forms(regimes and modes). Nowadays EU is the most matured organization in the regimes of sovereignty transference. There are two modes of sovereignty transference at present. One mode is that nations mutually transfer sovereignty among two or more states through bilateral or multilateral treaty and the other one is that one nation transfers its sovereignty on its own willing to international organizations.Chapter five mainly analyses the subject and object of the national sovereignty transference with self-determination and finity. Nations are the subject of national sovereignty transference. but they are not uniform. Based on the partition of full-sovereign and part-sovereign states, developing and developed countries and socialist and capitalist countries, the paper makes a comparative analysis of the three types of the subject of sovereignty transference and maintains that the diversity of the subject of sovereignty transference determines the development of itself. The acceptor of the sovereignty is the object of sovereignty transference. International organizations, regional organization, opposite states and multinational corporations are the main acceptors of sovereignty. With their respective organizational forms, nature and function, they take on the lacks of the national function in the era of globalization to guarantee the normal operation of the international system.Chapter six mainly analyses and sums up the general rules concerning the purpose, nature, principle and bound of sovereignty transference, and maintains that the purpose of national sovereignty transference lies in acquiring the maximal national interest. National sovereignty transference is completely on its own willing, but the nature of national sovereignty transference is not the same for the conditions and circumstances of nation states are not the same. To attain one's goal, necessary principles is needed and so states must obey some basic principles when transferring the sovereignty. Too much is as bad as too little. The key of the bound of sovereignty transference is that states must keep their own independence and the equilibration between the rights and duties.Chapter seven analyses the main factors influencing and circumscribing national sovereignty transference with self-determination and finity. Though national sovereignty transference has been accepted by most of the national states and is becoming a common phenomenon in international relations, there are a good many elements hidding behind the sovereignty transference that hinder its realization. The following situations are influencing the nation-state to transfer the sovereignty at different levels and to different degrees: the egocentric trend of the nation-state fostered by the classical theory that the nation-state is assumed to be a rational actor, the different circumstances developed and developing countries are facing in the globalization and their conflict in dealing with the sovereignty issue, the discrepancy of sovereignty at international system level and at national unit level, different degrees of anticipation of nation-state for absolute returns and relative returns in international cooperation, the paradox in dealing with national interests and international interests(or common interests), and so on.Chapter eight examines the realistic character of national sovereignty transference and analyses its development trend. From the angle of realistic character, national sovereignty transference is developing unbalancedly no matter at international level or at the national level. The main manifestation is that the international organizations or nation states who are centered in the globalization are more inclined to transfer the sovereignty to a higher degree and that those who are marginalized in the globalization are more passive and alert to the sovereignty transference. From the angle of development trend, the author believes that in the present age lacking of cosmopolitan authority but with limited order, sovereignty transference is the reasonable being during the transition stage of the world system. One of the essentials of the sovereignty transference is to confine the freedom of the national action felicitously in the fragmentized and homogenous world and seek the optimal point of equilibrium between the national and international interests.Chapter nine specializes in understanding and dealing with the issue of the sovereignty transference with self-determination and finity of China that is facing in the international arena. The paper firstly considers that China has always been the active participant in the globalization and the scope of the sovereignty transference of China carried out in the practice has become very comprehensive since reformation and opening up to the outside world. Secondly, the paper analyses the following problems of sovereignty transference China is facing currently: the problem of"laying aside the disputes and tapping together"and the disputes about territory and resource, the problem of vindicating the national interests after entering into the WTO, the problem of the internationalization of human rights and humanitarian intervention and the problem of the international anti-corruption cooperation and the national sovereignty transference, etc. Thirdly, sovereignty transference is a sensitive issue to the Chinese and how should we understand and treat it scientifically? The paper gives a detailed statement to these problems from the perspective of establishing new view on sovereignty and positive sovereignty, sticking to the basic sovereignty transference principles, understanding and treating the Western sovereignty transference theories scientifically, mastering the art of diplomacy and thinking about sovereignty transference dialectically.In the part of the epilogue, the author thinks that sovereignty transference with self-determination and finity is the dialectic negation of the traditional sovereignty but not the subversion and that its emerging and development reflects the realistic status and developing characteristic of the international relations and that it is a great breakthrough of the dilemma of sovereignty theory in the context of globalization and thus lessens effectively the contradiction and conflict between the globalization and the sovereign states. We should construct positively the theory and mechanism of the sovereignty transference and propel the development of the sovereignty transference course.
