Commerical Crime In China

The commercial crime is a serious social problem. It is continuously on the increaseand increases faster than thetraditional crimes. Also, the economic damage caused by the commercial crime is far bigger than the total economic damage caused by the other crimes. The commercial crime can seriously undermine the market economic order; it even may endanger a country's economic security. It also can influence political and social stability of a country. As a result, it is necessary to research on the commercial crime at present.Commerce is referred to all activities of commodity production and business operation and commercial services intended to make a profit that are related to commercial organiztions or activities. Commercial crime is referred to such activities that occur in the process of social reproduction, endanger the commodity exchange ordor, infringe commercial legal interests, violate criminal laws and should suffer the criminal punishment. Based on criminal jurisprudence and criminology, the author suggest that the basic characteristics of the commercial crime should include seven elements: (i) provided by law; (ii) various subjects of crime; (iii) compound form of crime; (iv) the criminal seeking for profits; (v) intelligent crime means; (vi) complex act; and (vii) multiple legal interests infringed.
