It has enough necessity to get science and technology policy legislated. On the aspect of "form of the sentence", contents in science and technology policy should be expressed as normative sentence before its being legislated, and the logistic structure of legal norm should be followed too. Does "legal sanction" act as an basic element of logic structure of legal norm? The anwser of why different Western Countries' researchers hold different views on logic structure of legal norm is largely base on the meaning they give for the words "legal norm" and "legal rule". Chinese scholars usually consider "legal norm" and "legal rule" have the same meaning, and this arises many confusion. The author hold the view that it is necessary to analyze logic structure of legal norm but not legal rule. Every legal norm is consist of two parts: "form of act" and "legal sanction", the part "form of act" can be seperate to "subject", "content" and "condition".Although there is "incommensurability" between rules which has been legislated and rules which has not been legislated, certain methods do exist to change the the form of certain contents in science and technology policy in order to let them be legislated.
