On The International Culture Products Trade Law At The View Of Administrative Law

According to my thesis topic and the outcomes of related fields which I have collected, collated and analysis, my research aim on international trade of cultural products is: In theory, beyond the existing research, to explore the legal theory of international trade of cultural products, in this regard, to fill some gaps in the theory. Based on the analysis for the existing international and domestic legal systems of the international trade of cultural products, I try to provide the legal reference for China's future negotiations for participation in WTO and UNESCO and other relevant international organizations. Try to provide a system solution for the Chinese laws and regulations on international cultural products trade.More specifically, I want to achieve the following objectives: a. Clarify the concepts and basic principles; b. Clean-up a set of theory on international cultural products trade; c. Design a suitable system of rules for contemporary Chinese international cultural products trade. Whether the research is on the rules of international cultural products trade, or the study of relevant domestic rules, the final end result should be that through possible institutional and legal means to safeguard China's national interests.While the function of international cultural products trade rules are many, and in the process of actual implementation of these rules, the targets would be differ due to the time and place, the study of international and other countries'cultural products trade rules is in order to better serve the establishment and operation of the China's international cultural products trade rules, with the ultimate goal can only be and must be to safeguard China's national interests and cultural security.Based on research objectives and the choice of paths, in addition to introduction part, the thesis would be divided into five chapters.Introduction part describes the study background and research methods and process paths.Chapter I is the detailed division of culture, cultural industries and cultural products which mainly involved in an international cultural products trade, and elaborate the link and differences among the international cultural products trade, international services trade, international intellectual property rights trade.Chapter II is the analysis and traceability of the international cultural products trade, its semantics of the rules, principles, origins, values and legitimacy of the basic principles etc, in order to clarify the connotation and denotation of this study, to define the scope of the study.Chapterâ…¢is the empirical investigation on international legal system of the international cultural products trade, mainly on the UNESCO"Convention on the Protection and Promotion of the Diversity of Cultural Expressions"and the relevant WTO rules. The author's view is that, on the one hand, there are some rules of international cultural products trade in WTO rules, but less comprehensive and detailed, and some may be conflict with the"Convention on the Protection and Promotion of the Diversity of Cultural Expressions"and other international conventions; the other hand, other international covenants which will enrich and develop the content of WTO rules.Chapterâ…£is the research of the Controversy between the free trade and trade protectionism in the international cultural products trade, based on discussion, in and protection of cultural products, as well as resolution for the disputes between the two path selections.Chapter V deals mainly with legal system of China's international cultural products trade. According to the existing rules and current international cultural products trade, how to learn from practice and experience of foreign countries; in the WTO and UNESCO and other relevant international negotiations, what are the China's positions and strategies, how to construct China's international cultural products trade rules to meet the challenges of international cultural products trade, to promote China's cultural products trade, all these problems are the focus argument in this chapter.
