Research On Duty Crimes Of Medical System

In recent years, extensive job-related crimes which happen in health system, as a "cancer" of the harmonious society, is damaging the credibility of the medical staff and corrupting the society. How to more effectively prevent job-related crimes of medical system is central to our objective of the study on job-related crimes. In this dissertation, we will comply with "the phenomenon-the cause-the prevention "of crime of such a study of the basic paradigm for clues on the job-related crimes to explore something in depth.First, we conduct an empirical survey of duty crimes relating to health care system to summarize the characteristics of official crimes committed in health care system, try to figure out features of the power loss of medical power, utilizing such kinds of social scientific method as comparative research, empirical analysis, specification analysis, system feasibility studies and other research methods, like qualitative and quantitative, macro and micro combined. Secondly, the investigation of duty crimes of health care system within Nanjing helps us find the power control various medical reasons, in-depth study of the health care system and control measures Official Crimes and other principles of economics. Finally, we present suggestions to restrain health care power.In the introduction section,we briefly describe the academic motive to carry out the research and the significance to do this kind of research.To prepare to write this dissertation we have read many research papers and academic books.After that we point out research progress and depth of domestic and foreign research. It is crucial to do this kind of research, because it helps me to find a logical starting point, and provide details on research methods.The second chapter is the category of duty crimes of health care system. First of all, we analyze the philosophical base of the health care system and demonstrate the power of health care systems and medical concepts. Medical power has two types, specificity and universality, which produce different effects, such as positive and negative effects, according to medical authority in the implementation process. Then we analyze the alienation of medical power, which in real life causes the duty crimes of health care system. It offers a solid foundation for full analysis of duty crimes of medical system. Then we discuss the relationship between duty crimes of health care system and medical corruption and point out that they have a mutual tolerance and can be interchangeable in informal relations. Finally, we demonstrate that prevention and treatment of duty crimes of health care system is primarily aimed to curb medical power.In chapter Ⅲ, we introduce the relative phenomenon of duty crimes within health system. Then we introduce the background investigations of the phenomenon of job-related crimes of recent years carried out by the Institute for Crime Prevention and Control of Nanjing University and the People’s Procuratorate of the Gulou District. We take part in the researching program from the beginning to the end.Based on the survey, we find out that containing the medical authority is urgent and necessary.The fourth chapter is discussion of the reasons for job-related crimes within the health care system. First, we explain the structure of crime through the general principles of job-related crimes; second, we find causes of the power of social alienation and the individual. The reason for the social causes of medical power of alienation is mainly health care reformation, less raising fund from the state, increased medical revenues for the devolution of management rights and medicine together with pricing, etc. without having appropriate supervision. Coupled with social climate and other factors exacerbate the loss of control of medical power, crimes committed in medical systems lead to more crimes in other parts. To seek the self-interest maximization, power without supervision usually brings disasters to medical system. Official Crimes within health care system is a cost-benefit of behavior, where medical staff will intentionally or unintentionally make cost-benefit calculation.Only when their expected returns surpass its expected costs, will the parties choose the medical corruption. When the medical corruption is less than the cost of expected benefits, they will stay away from medical corruption. Due to psychological imbalance of the medical staff, and through the cost-benefit calculation, they actively commit duty crimes of the health care systemThe fifth chapter is about prevention and cure of duty crimes within health care system.we firstly explicate the objectives and principles of prevention and cure. Because the crimes committed in health care system are causes of many factors, so we must take control of various measures to obtain the best results. Finally, we present constraints on the right to health care systems of medical duties specific crime prevention strategies and recommendations. We hope that these measures can effectively control the health care system of Official Crimes, and this is where the purpose of this dissertation.
