Research On Value Orientation Of Amending "People’s Republic Of China Sports Law"

The external environment and internal needs of sports industry present a new trend in Chinese economic and social reform.The existing "Sports Law" to some extent can not meet the practical needs of Sports,so it is necessary to revise and improve it.And the value orientation is the premise for the revision,the most important for legislation,and the standard and basis to create,evaluate,modify and repeal the law.So it is very important to research the value orientation of revision. And this thesis is divided into seven parts.The first part is the introduction.The State Sports General Administration has made it clear to amend the "Sports Law".The existing "Sports Law" can no longer meet the social development and demands of sports.Value orientation of law means a kind of tendency of special subject when choosing the value target.It embodies the essence and purpose of the legislation,impacts the choice of legislative model,and is the core and soul of law.So values orientation is the issue of amending the "Sports Law".The second part is the outline of value orientation of law.This part aims to define the value orientation through the analysis of value,value orientation,implication and classification of values orientation,and also to determine the intention of value orientation.The third part is about the analysis of the existing "Sports Law".By analyzing the legislation and implementation of "Sports Law" to reflect the value orientation, point out that value orientation of present "Sports Law" has certain guiding sense under that social background,and meets the social development demands.But after promulgation implementation,along with the market economy,the democratic government by law,civil society’s development,its inelasticity highlights day by day. The value orientation of present "Sports Law" overweight the imbalance management potency,the citizen sports right is not very prominent.What manifests in the rights and obligations relations is the voluntary standard.So it needs to revise "Sports Law" to the future value orientation carries on locates.The fourth part is about the objective basis of amending value orientation of "Sports Law".This section is mainly through analyzing the change on value orientation of economic restructuring,new requirements of the well-off society and harmonious society,and the democracy reform to analyze the influences to modify "Sports Law".And this thesis combines the trend analysis of sports reform and development to finally establish the objective basis of revision.The fifth part is about the establishment of value orientation.The market economy,democratic government by law,civil society as well as sports’ goal and value are humanist,manifests in the legal view for the right standard.The amending of "Sports Law" must take the right as the standard,the establishment basic value orientation is confirming and safeguarding citizen’s sports right.The basic value orientation respectively is insisting the country’s impetus to sports;insisting sports scientific development;insisting sports socialized development;insisting sports industrial development;insisting sports governed by law and sports institutional innovations.Part sixth is about the embodiment of value orientation of "Sports Law"."Sports Law" protects all kinds of sports rights and ensures that country can exercise management rights according to law,make clear the status and direction of sports industry and control a variety of benefits.Therefore,the thesis puts forward my views through analyzing social sports,competitive sports,school sports,sports social organizations,sports marketing and management activities,protective conditions and legal responsibility.The last part is the conclusion,summarizing the full text.The paper definite the fundamental and basic value orientation of amending" Sports Law",and outlook the legislation embodies.
