Research On Protection And Application Of China's Geographical Indications In The Context Of Internet

The Agreement on Trade-Related intellectual property Rights(TRIPS Agreement)is one of the most important agreements with regard to the protection of geographical indications.In this agreement,geographical indication is paralleled with patent,trademark and other intellectual properties.In China,the wide research on geographical indications is after China's entry into the World Trade Organization(WTO),no more than twenty years so far,there are some problems in the establishment of protection system and application.From the perspective of internet,the dissertation studies the protection and application of China's geographical indications which is defined by TRIPS Agreement that is managed by the WTO.Firstly,the dissertation introduced the background as well as the significance of the research,analyzes some related concepts and selects the definition which is used in this dissertation.Then use the methods of case analysis and statistical analysis to study the current situation of the protection of geographical indications in China,it shows that there are some problems,such as causes rights conflicts because of multi-channel management,doesn't fully meet the requirements of TRIPS Agreement,increases the cost of protection,ignores the rights of consumers and so on.In order to learn from foreign experience,the dissertation comparatively analyses the mode of geographical indications protection in two most developed economies:The European Union and the United States and analyses the essential reasons,the conclusion is of great significance to the protection of geographical indications in our country.The rapid development of internet in China brings forward profound influences to all walks of life in China,geographical indication is without exception.After analyzing the impacts on geographical indications,the dissertation puts forward some countermeasures from the perspective of laws and policies respectively.On the one hand,many reasons show that China should adopt the mode of special law,on the other hand,the government should issue some measures to promote the protection of geographical indications,such as support the operators to register geographical indications,to develop the quality of geographical indications,to protect their own rights,and to construct the culture of geographical indications.With the development of cross-border E-commerce,the overseas protection of China's geographical indications will be more and more important,the dissertation gives some proposals.In order to give full play to the value of geographical indications of China,this dissertation puts forward the idea of additional protection to some specific geographical indications which are of great value to China,the concept of specific geographical indications,selection method and protection measures are also discussed.The aim of geographical indications protection is to make better use of the value,which can be realized by putting them into application.In the context of internet,the government,the intermediate organizations and the enterprises should play their roles well to promote the application of geographical indications.The government should take measures to create favorable environment,such as eliminating digital gap between the urban and rural areas,developing e-commerce talents in rural areas.The intermediate organizations should transform actively,make full use of internet to fulfill their responsibilities.As to the enterprises,the core issue is the branding of geographical indications,including brand symbol design,brand positioning,and brand communication by internet.
