The system of selecting and appointing cadres with Chinese characteristics is an important part of China's political system.It not only decides what kind of people to choose and how to choose,but also decides what kind of people to implement the policies and ideas of the ruling party.Nowadays,more and more scholars at home and abroad pay attention to China's political model of selecting and appointing talents.The core of this political model is the line of "appointing only talents" and the standard of "combining virtue and talent"."Fairness and justice" has gradually become the value guide of the CPC in governing the country and administration.It is of both theoretical and practical significance to study and analyze the justice of the system of selecting and Appointing Leading Cadres of the CPC and government.The theory of procedural justice provides a good theoretical analysis tool for the justice consideration of the system of selecting and appointing cadres with Chinese characteristics.The introduction mainly introduces the research background,research significance,core concepts,literature review and research ideas and methods of the article.The first chapter is an overview of the basic theories involved in the article.What is justice? What is distributive justice? What is procedural justice? Justice must not only be done,but must be seen to be done.The author holds that adhering to the independence of procedural justice is conducive to better achieving substantive justice.But the discussion of procedural justice can never be separated from the essential requirement of substantive justice.Procedures deviating from substantive justice must be adjusted and amended.The second chapter focuses on the substantive justice of the selection and appointment of Chinese party and government leading cadres.The article holds that the selection and appointment of cadres is the essential justice of the selection and appointment of leading cadres of the Party and government in China,and the procedure of the selection and appointment of cadres obeys the essential requirement of serving this requirement.From the perspective of the development context,"appointing only meritocracy" and "combining virtue and talent" have always been the basic standards for the Communist Party of China to train,inspect and use cadres.From the perspective of cultural connotation,"selecting virtues and appointing talents" not only has distinct Chinese traditional culture characteristics,and proletarian party attributes,but also contains the core connotation of fairness and justice.From the perspective of political function,the determination of the cadre line criteria of "appointing only meritocracy" and "combining virtue and talent" not only provides a judgment criteria and basis for the selection and use of what kind of cadres,but also plays an irreplaceable role in shaping the party's authority and consolidating the legitimacy of the regime for the Communist Party of China.The third chapter focuses on the process of participation in the selection and appointment of leading Party and government cadres,that is,democratic recommendation.The democratic recommendation system is a great contribution of the Communist Party of China to the innovation and development of the "appointment system" of cadre selection.In the process of the development of democratic recommendation system,the two negative factors,namely,the simple use of votes to get people and the unhealthy tendency of canvassing votes,have always been affecting and restricting the effectiveness of the system.The democratic recommendation system has gone through the conflict between ideal and reality,the confrontation between being and ought to be,the distortion of starting point and process,and finally been reformed,perfected,adjusted and revised,showing the ability of the Communist Party of China to innovate itself.The deviation and adjustment of democratic recommendation system is a typical case of correcting procedure after the conflict between procedural justice and substantive justice.This chapter deeply analyzes the intricate internal factors of the deviation of democratic recommendation system,and provides reference for avoiding the party's system construction and reform.The fourth chapter deeply discusses and analyses the procedural justice of cadre inspection procedure.Cadre inspection is the core procedure of the CPC's "selecting virtues and appointing talents".On the basis of sorting out its historical context and system development,this chapter focuses on the analysis of the political functions and system attributes of the cadre inspection procedure,and makes a theoretical analysis and normative study of the inherent contradictions and multiple dilemmas in the cadre inspection procedure,thus putting forward the path selection and concrete suggestions for the reform and development of the cadre inspection procedure.The fifth chapter focuses on the decision-making process of the selection and appointment of leading cadres of the Party and government.The author believes that deliberation and decision is a distinctive feature of the decision-making process of selecting and appointing cadres with Chinese characteristics.Democracy and centralization play a role of checks and balances in the decision-making process of cadre selection and appointment.Convention and rules are the internal operating mechanism of the decision-making process of cadre selection and appointment.The sixth chapter is the conclusion of the article,which combs the thread of the realization of procedural justice in the selection and appointment of leading cadres of the Party and government in China.Generally speaking,the distribution of public posts according to what principles is a matter of cadre selection criteria,but also a matter of substantive justice;the development of the main procedure,that is,what procedure is used to select and employ persons,is the initial distribution of justice;in the conflict between procedural justice and substantive justice,on the one hand,the main procedure should be revised and adjusted.It is the redistribution of justice;on the other hand,it is necessary to establish corrective procedures to prohibit and punish unjust acts that violate substantive justice.
