Abstract/Summary:
The initial purpose of this research is to present a new approach to the substance, form and content of the Controversy at Valladolid, Spain, in 1550 and 1551. This dispute between Fray Bartolomé de Las Casas, called the defender of the universal rights of the Amerindians, and Juan Ginés de Sepúlveda, the imperial chronicler for the Spanish crown, took place in the most crucial moment for Spanish America in the sixteenth century.; This detailed analysis of the Debate at Valladolid not only provides us with a current update that is relevant to Western history, but also facilitates the access to the legal, theological and philosophical aspects of natural law, and to the examination of the legalistic dialogue which has characterized the origin of Latin American narrative. The complexity of this interdisciplinary approximation arises and opens the avenue to literary analysis. Only by reviewing this can the extreme relevancy be recovered from a polemic that has refused to be forgotten, and opens up to interdisciplinary alternatives that it has sought in current literary cristicism.; In the exposition of the Debate the positive aspects of each of the parties are discussed. These led to an outpouring of literary production, especially by Fray Bartolomé de Las Casas, regarding the themes of the universal declaration of human rights as seen in La Apología. This work is examined in such manner that establishes it as a primary text of legal rhetoric. In this perspective, one of the new literary currents is analyzed within the legal field of literature, which has come to be known as Law and Literature.
