The Study On Battered Women Who Kill Husbands Or Partneres

Domestic violence is a world problem, far from something like simple housework. Domestic violence can even lead to those facts such as death of the suffered, or the death of the offenders who are killed by the suffered.Domestic violence problem has been paid attention to since the 70's in the west society. According to the problems, a set of theories and practice pattern has been developed until now. In China domestic violence problem has been paid close attention to since 1995 when the fourth World Women Conference was held. Although some accomplishment has been achieved after efforts within over ten years, there is still gap between the western countries and China, especial in the filed of killing husbands by the suffered wives involved in domestic violence. Some problems has not been discussed or studied deeply.Based on the related studies on China and abroad, the writer did some investigation by questionnaire, interview and scale measures. The papers of questionnaire are 121, 25 women who suffered domestic violence and killed their husbands were interviewed in prison, case information from court verdicts are also analyzed. Through the analyses we can conclude that domestic violence is one of main reasons to lead to the crime such as intentional injury or intentional kill offended by women suffered domestic violence. Those women can be divided into two groups; one is those who could not bear domestic violence and killed their husbands, the other is those who suffered domestic violence incidentally assaulted each other and killed their husbands. We think that the first group is more typical. As the homicide is concerned, there are some reasons such as desperation to endless violence, legislation under development, special personal conditions of the suffered women, to explain such a crime.Given the fault of victim who were killed involved with domestic violence, generally speaking, the social harmfulness and personal criminality of those women are not very serious. Therefore, the writer advise that we should think over“domestic violence and the following consequence”in both the legislative and judicial fields. As for the corrections, community-based corrections are recommended generally. In addition, psychological corrections, the domestic violence prevention law, the interconnected system involved in the police, community and hospitals are should be established and developed.
