the report of the 19 th national congress of the communist party of China put forward: China’s economy has shifted from the stage of high-speed growth to the stage of high-quality development,and innovation is the first driving force to lead the development.Both neoclassical growth theory and new growth theory point out that technological innovation is the most fundamental factor for long-term high-quality economic growth,and R&D is an important way to realize technological progress.Neo-Schumpeterian believes that economic growth is a dynamic process of "creative breakthrough" and that new technologies and new products are the manifestation of economic growth by constantly eliminating backward technologies and products.Intellectual property protection is an important policy of human "invention".As a policy tool to solve the market failure of technological innovation,it has been widely concerned by economic research.Strict intellectual property rights protection system can guarantee the monopoly power and innovation income of the technological innovation owners,which plays a very important role in stimulating the R&D investment of enterprises.Does strengthening the intellectual property protection system help promote technological innovation? The existing research is lack of rigorous microscopic empirical evidence.This article will focus on discussing the basic proposition of how "the protection of intellectual property rights affects enterprises to export competitiveness" from the perspective of "patent paradox".Inductive deductive method,theoretical analysis and empirical analysis of large sample,instrumental variable method,case comparison analysis,and other research methods were integrated applicated to discuss the following issues: the protection of intellectual property rights and enterprise innovation breakthrough type,the relationship between the protection of intellectual property rights and the relationship between export competitiveness,the protection of intellectual property rights,and enterprise some researches on the relationship between total factor productivity.The above problems were systematic discussed by multiple regression and instrumental variable method,and the research conclusions were summarized below:First,there is a nonlinear inverted u-shaped relationship between intellectual property protection and enterprise breakthrough innovation in China,that is,with the increase of intellectual property protection level,enterprise breakthrough innovation behavior shows a trend of rising first and then falling,and indicates that there is an optimal level of intellectual property protection.It is found that the higher the economy developed,the lower the optimal level of intellectual property protection is.Compared with non-state-owned enterprises,the optimal level of IP protection applicable to state-owned enterprises is higher.Compared with the low-knowledge-intensive industry,the optimal intellectual property protection level applicable to the high-knowledge-intensive industry is higher.The above research conclusion is still valid after a series of robustness and endogeneity control.The above research empirically tested the relationship between intellectual property protection and enterprise breakthrough innovation with detailed micro data based on the characteristics of China’s transition economy,and extended the optimal intellectual property protection theory obtained by mainstream literature based on transnational sample data to the field of breakthrough innovation of micro enterprises.Second,consistent with the breakthrough innovation research results,the protection of intellectual property rights and enterprise export competitiveness is also characterized by nonlinear inverted u-shaped relationship,namely force tend to be more strict with the protection of intellectual property rights,export competitiveness has a downward trend after rising first,after a series of robustness tests and causal relation recognition found the research conclusion is still robust.Cross-sectional examination showed that the inverted u-shaped relationship between intellectual property protection and export competitiveness of enterprises is more applicable in regions with higher economic development level,while the most applicable intellectual property protection level is higher in state-owned enterprises and even in industries with higher knowledge intensity.This study not only revealed the protection of intellectual property rights of enterprises breakthrough type affects the economic consequences of innovation from the perspectives of enterprises export competitiveness,but also based on the economic development stage,property attributes,knowledge enterprises characteristics,such as intensity and degree of competition in the market and industry characteristics,such as institutional environment characteristics reveal the aspects such as the optimal protection of intellectual property rights "hypothesis" the application of the boundary.It will put forward China’s situation and down for us "optimal boundary protection of intellectual property rights theory".Third,with the enterprise innovation and breakthrough type export competitiveness study,the protection of intellectual property rights and enterprise total factor productivity is a non-linear inverted u-shaped relationship,namely as the strictly on the protection of intellectual property rights,total factor productivity has a downward trend after rising first,and the economic development level,knowledge property right attribute,intensity and degree of competition in the market and regional marketization process on the protection of intellectual property rights and enterprise inverted u-shaped relationship between total factor productivity has significant effect of adjusting,series of robustness tests and endogenous after processing.The relationship between intellectual property protection and total factor productivity is robust.This part of the study will not only help to reveal the protection of intellectual property rights from the perspective of enterprise total factor productivity and the relationship between enterprise innovation breakthrough type consequences,but also verify the optimal protection of intellectual property rights theory,and expand and deepen the system of determinant of micro enterprise total factor productivity from the perspective of the protection of intellectual property rights.It is of great academic value and realistic significance.The academic value and innovation points of this research are mainly reflected as follows:First,the "optimal intellectual property protection hypothesis" was put forward from the perspective of breakthrough innovation,which extends and deepens the intellectual property protection theory.Existing literature about the optimal protection of intellectual property rights "hypothesis or research focused on the macro level,does not distinguish between incremental innovation and breakthrough innovation characteristic difference,according to the unique characteristics of the breakthrough innovation to research the optimal protection of intellectual property rights"hypothesis ",this research studied the "protection of intellectual property rights and enterprise breakthrough innovation" nonlinear causal relationship based on detailed micro data,and further investigated the export competitiveness of enterprises and enterprise consequences such as total factor productivity,and thus expanded and deepened the "optimal protection of intellectual property rights theory".Second,the endogenous relationship between intellectual property protection and breakthrough innovation was overcome,and the causal relationship between them was identified based on the instrumental variable method.The relationship between the protection of intellectual property rights and enterprise innovation was difficult to be accurately identified,as the intellectual property rights protection system is difficult to measure and less clean natural experiment for the existing research on the protection of intellectual property rights and innovation.This research recognized the relationship between the protection of intellectual property rights and enterprise innovation breakthrough type of cause and effect and revealed the "optimal protection of intellectual property rights" as an important economic law according to the instrumental variable method developed by Wu Chaopeng and Tang Di.Third,this research revealed the mechanism of IP protection promoting economic growth,and provided theoretical basis for China to develop a more scientific and rational IP protection system from the perspectives of breakthrough innovation,export competitiveness and total factor productivity.The current economy of our country is in the crucial period of rapid growth to the high-quality development.The transition from elements drive to innovation drive is the fundamental starting point of the future of our country economic policy.Thus,this research on intellectual property protection level and the innovation of enterprise breakthrough "optimal protection of intellectual property rights theory",not only from the enterprise innovation,breakthrough type export competition and total factor productivity,etc,to reveal the specific mechanism of intellectual property rights protection to promote economic growth,but also help our country develop a more scientific system of intellectual property rights(IPRs)protection.
