Study On Legal Issues Of China's Oil And Gas Exploration And Development

Being strategic resources, oil and gas resources, especially its security, have been the most important concerns by the governments in most countries of the world. At present in China, some related departments of the State Council, and of the local governments which governing the areas rich in oil and gas resources have centered on the exploration and development of oil and gas resources, the legal system on exploration and development of oil and gas is not very perfect, and the study on the legislation issues related to oil and gas resources is in its initial stage.This paper, with the basis of analyzing some foreign legislation experience about the exploration and development of oil and gas, firstly summarizes the situation of exploration and development and the status quo of oil and gas legislation, then, combining the main problems needed to be resolved, puts forward the specific suggestions establishing and improving the legal systems of exploration and development. The major innovations of the paper lie in proposing the framework of mining management system, setting market access conditions, increasing incentives by taxation policy, strengthening industrial safety review and environmental protection etc.
