On The Legal Protection Of China Wildlife Species Resources

In recent years, concern of biodiversity and ecological safety is growing day by day.To environmental law experts and practitioners, for invasive species, genetically modified organisms and other hot topics of research are increasingly in-depth and many works. By comparison, the focus on native species in particular native wildlife species are really little, but in fact our loss of wildlife resources and loss of species is very serious, and has'nt yet to establish a sound institutional system to be effective response, thus it is necessary to explore from the perspective of the rule of law.Biological species is actually a broad species, besides the species-level diversity, also contains the kinds of genetic resources and agriculture within the meaning of germplasm breeding. This article referred to "wildlife species resources" to include the concept of three aspects: nature, wild plant, animal and microbial species; artificial cultivation of crops and varieties of wild relatives; these two species contain functional units of heredity (genes and DNA level) of the material, namely genetic material.Biological species resources as the main content and the core part of a country's ecological security and even has an important role in the foundation of national security. China is one of most animal and plant resource-rich countries in the world, but because of rapid population growth, overexploitation of resources, introduction of alien species, illegal foreign individuals and organizations Pirates plunder, pollution and climate change and other factors, loss of wild species resources comes more and more seriously. The so-called "loss", mainly refers to the number of wildlife species, means population reduce, and "outflow", it mainly refers to the loss of biological genetic resources abroad. So far, China has established the environmental impact assessment system, nature reserves and National Parks system, licensing system and the quarantine system as the core of the legal system to protect the biological diversity of the initial realization of the biological species resources protection legal system, but also to take a number of effective response measures.However, to the protection of wildlife species resources in our country, whether in the idea, legislative skills, the legal system or running mechanism (management system) level, there are severe defects, urgent need to be consummated. The third sector is about the legal protection of wildlife species resources in United States, Australia, Germany and other developed countries, mechanisms and resources to protect wildlife species were studied in international cooperation, and better focus on the "Endangered Species Act", "Biodiversity Conservation Convention "and the Asian species, conservation of wildlife and national cooperation in-depth research.On the basis of the above, the fourth part of this article in our country practice to perfect the legislation system and the run mechanism put forward on proper species of wild biological resources law-protection system proposals and ideas. Legislative system, China has a need for conservation of biological species rose to national strategies and ecological holism as the guide, improve the legal system including the nature reserve system, biological species register system, national biological species resources benefit compensation system, public participation system, environment impact on biological species resources evaluation system, regional cooperation in conservation of biological species. Operating mechanism, to establish official cooperation mechanism, investigation and monitoring mechanisms, early warning mechanism, regulation and excitation mechanisms, incentives and benefit sharing of genetic resource acquisition mechanisms, and thus construct our wild biological species conservation structure by the rule of law.
