Study On China's Environmental Enforcement Situation And Countermeasures

Favorable ecological environment is the basis of human beings'life and social, economic development, and it's necessary to realize the sustainable development strategy. As now, human beings have created material and spiritual civilization, which also causes a lot of environmental issues. Ecological environment has been destroyed a lot since the policy of reform and opening to the outside world was implemented. Environmental issue has been a great obstacle of economic development in China.How to solve environmental issue effectively and cope with the relationship between economic development and environment protection exactly is a tough task confronting China's government. Recently, China's government pays more and more attention to environmental issue and has taken environment protection as important as economic development. Environment protection has been one of basic national policies in our country. However, the severe environmental situation hasn't been change fundamentally, and the effect of environmental law execution is still too low. Under the circumstances, how to strengthen and improve law executing has become one of the topics that academe should pay more attention to.This paper reveals some problems of environmental law execution in our country based on the analysis on its actuality as follows: the disturbance of local governments, environmental management sectors'lack of independence, lack of specific law, too many executing main bodies and so on. Then it analyzes the deep reasons for the fact that it's too difficult to execute environmental law from the views of legal system, mechanism and the ability of executing and analyzes the succeeding mode in other countries and succeeding exploration in some places of our country. At last, the paper puts forward some countermeasures against difficult problems of environmental law execution: coordinate current environmental law, make up environmental blank, strengthen the operation of environmental law and consummate environmental law system under the direction of scientific development view and the objective of building resource-conserving, environment-friendly society; reform and consummate the leading and supervising system of environmental management sector and reinforce the cooperation of environmental law execution in different places and sectors; improve the assessment system of cadre and the duty system of environmental protection and boost up local governments'consciousness of environment protection; enhance ability construction of environmental law execution, endow environmental protection sector with more popedom, reinforce the compulsion and authority of environmental law execution, increase the investment of environment protection, strengthen the procession construction of environmental law execution and improve their diathesis to provide strong guarantee of human resources.
