A Study On The Legal System Of Environmental Labeling In The View Of Ecological Consumption

In order to meet the objective requirements of consumers'increasing concern about environmental protection and to meet the situation that major changes have happened to way of environmental management, environmental labeling came into being in the latter half of last century. Since the environmental labeling system goes without the mandatory which traditional means of administration have but achieve effective protection of the environment and good social effects through the way of inductively economic incentives, it becomes a wide concern by countries. Drawing form analysis, environmental label should be the special symbols or signs the applicant is agreed to use by an independent third party based on certain criteria which show that the products and services meet the environmental requirements in their life cycles. According to the classification of the International Organization for Standardization, environmental label can be subdivided into Typeâ… , Typeâ…¡and Typeâ…¢Environment Label, these three types have their own adjust target characteristics to meet businessmen and consumer's the different needs.In the second part of this article, the implementation status of the environmental labeling system abroad is discussed. Since 1977, more than 30 countries in the world have set up their own environmental labeling system and accumulated abundant experience in the management agencies of environmental labeling, the procedure to develop standards of environmental labeling products, public participation in environmental labeling system, daily management of environmental labeling as well as international cooperation and mutual recognition in environmental labeling, these are worthy of our country's absorbing and learning. At the same time, in the"Agenda 21"as well as in the relevant provisions of the World Trade Organization and the International Organization for Standardization, environmental labeling is also regulated. These regulations play an active role in promoting mutual recognition and cooperation among states.The third part of this paper gives a specific analysis of the status quo of China's environmental labeling system. China's environmental labeling system was officially launched in 1993, after more than a decade's development, the process of rule of law of China's environmental labeling system has stepped on the right track. A legal security system giving priority to environmental management and taking trademark protection and contracts protection as the main form has initially come into being. It should be noted however that China's environmental labeling system still have many problems, the most important reason is that the design of the environmental labeling system itself is not reasonable: the system itself is not sound enough and the relevant auxiliary system's supporting security is lacked; the environmental labeling system has become a single, isolated system; although a series of laws and regulations as well as the promulgation of policies has contributed to the building of environmental labeling system, it is just a simple framework; so, China's environmental labeling system is still in the initial stage, continuously improvement is needed. Clear about these problems is the beginning of our next step.In the fourth part of this article, a reform to the environmental labeling system is launched from the perspective of ecological consumption, and some specific proposals to China's environmental labeling system are put forward. Then first of all its position should be made clear: environmental labeling system is a specific system of the ecological consumption legal system, at the same time, it is at the heart of the ecological consumption legal system. Environmental labeling system is the consumers'obligation. A correct understanding of this point will help to build a friendly relationship between human beings and the environment, to achieve harmony between people, and truly reflect the value of human existence. Of course, the environmental labeling system itself should also be continuously refined and improved, for example, the "Regulation on Environmental Labeling" should be enacted as soon as possible, relevant aspects of environmental labeling management should be improved, the way for public participation should be clarified, the relief system of environmental labeling should be developed and so on. What's more important is that environmental labeling system should not be independent, it should be linked and coordinated with other relevant systems of the ecological consumption legal system. According to earlier analysis, the government's green subsidy system, the government's green procurement system, the consumption tax system as well as the green credit system and so on should be matching systems of environmental labeling system, thus the ecological consumption legal system with environmental labeling system as the core can be reasonably set up to truly exert the actual effect of environmental labeling and to carry out its function of guiding consumers'behaviors.
