China, as a large agricultural country, the country's stability and the sustainable development of economic are closely linked with the security of the rural soil. With the rapid development of modern agriculture in China's rural areas, over-exploitation of soil resources, township enterprises blossom everywhere, the transfer of polluting industries from the developed countries and China's large and medium cities to rural areas, the increasingly high cost of living environment in rural areas brought serious pollution and damage to soil. Pollution problems in rural areas become increasingly prominent. Soil pollution in rural areas not only directly affects the security of the rural ecological environment, threatens the.survival of neighboring species, but also endangers the health and safety of human and animals. Therefore, the strengthening of soil pollution prevention, protection, and improving the rural ecological environment has become essential. So with the kind of legal strategies to prevent and control the occurrence of soil pollution in rural areas had become the major propositions between a bearing on people's livelihood and social stability of the relationship.This article through the depth of dialysis status of soil pollution in rural areas, the influence of the soil pollution on the surrounding to environment and residents, the causes of soil pollution in rural areas and so on, focusing on the analysis to the legal status of prevention and control of the soil pollution in rural areas from a legal point of view. And puts forward legal measures related to the prevention and control of soil pollution in rural areas. The structure of this paper is as follows:First of all, by introducing the status of China's rural areas pollution, the influence on the surrounding environment and human and animal'health, analyze the great damage when the soil is polluted. Indicate the pollution not only would destroy the balance of the rural ecological environment, but also result in food production and other economic losses, and even threaten the food security of rural and urban dwellers. And illustrate the importance of prevention and control the soil pollution in rural areas.Second, analysis the legal status of China's current prevention and control of soil pollution in the rural areas, respectively. from legislation, law enforcement, the judicature, the protection of the environment right of the peasants and so on. And expound China's existing legal mechanisms' shortage or the part need to improve in the prevention and control of soil pollution in rural areas, to pave the way for the following legal measures that would be proposed.Finally, against the legal deficiencies of soil pollution prevention and control in rural areas, study the legal measures of the prevention and control of soil pollution in rural areas, respectively from improving the environmental legislation related to soil protection, strengthening the law enforcement of environmental administrative, and perfecting judicial relief of the soil pollution, establishing the financial system to compensate the damages, protecting farmers'environmental rights and so on.
