Legal Study Of Corporate Environmental Responsibility System In China

The sustainable development of our current social economic society in China is generally regarded as the coordinated development among the factors, such as economy, population, resources, and environment, etc. Society relies on enterprise and enterprise is the cell of society. In social and economic life, enterprise plays an important role in the environmental issues. On one hand, it applies advanced technology to obtain high profits from natural resources, on the other hand such behavior leads to the flooding of public hazards, such as serious air and water pollution, which badly threaten the public health, safety, and social environment. As the principal consumer of natural resources and also the polluter, enterprise has compelling obligation to use and protect natural environment in a rational way. Our government, especially in the current, in order to achieve sustainable social and economic development, has adopted a new policy in which the traditional extensive economic mode is transformed into a sustainable one. Therefore, how to continuously enhance the system of corporate environmental responsibility has become a severe and urgent issue.In view of this, the paper studies on the subject"the corporate environmental responsibility system in China". The first part summarizes the corporate environmental responsibility by firstly defining its connotation, secondly carrying out the economic law analysis of it and meanwhile stating its feasibility. The second part analyses the existing problems and explains why. The problems are as below: a weak awareness of environmental responsibility; seriously doing harm to the environment; lack of effective measures to protect and a gap with the required standard of the international treaties, etc. The reasons are not far to seek. Generally speaking, the legal system of corporate environmental responsibility is not perfect yet in China. As for legislation aspect, not very enough concern has been given and quite a few blind areas exist in current legislation. Moreover, the legislation rules are not very standard, organized and practical to be operated, which leads to the status of law being fairly weak. As for the purposes to bind and inspire the enterprises'responsibility to carry out the environment plan, the mechanisms are far from integrity, so is the social supervising mechanism. The third part investigates the current development of foreign corporate environmental responsibility system, respectively introducing the systems in US, UK and Germany. Based on previous research, being the key point of the whole article, the fourth part puts forward the policies on systematizing the corporate environmental responsibility. First, it proposes the assumption of how it can be structured: to build an enterprise-based system, assisted by government and consumers; to set rules and regulations according to the demand of cyclic economy and to carry them out in a mandate-induce way. Second, it analyses several system-construction-related measures and proposals in details: to improve the legislation system to guide the enterprises to fulfill their responsibility actively; to improve assurance system; to improve the binding and inspiring mechanism; to improve responsibility extension system for producers, and to establish a standard social supervising mechanism.From what has been said above, the paper is expected to bear a guiding effect on constructing and nurturing the corporate environmental responsibility system in China.
