Comparative Study On System Of Cross-Straits In Fishery Law Enforcement

The development of fishery plays an important role in economy of both mainland of China and Taiwan.The mainland has a long history of aquaculture which has the most output in the world.However,the dominant mode in this kind of industry is a extensive form.The offshore fishing industry started late with poor technical equipment and experience.Many coastal areas are not strong enough to be competitive. In comparison,offshore fishing industry in Taiwan is more mature.both in technology and extent to maintain the leading status in the world.However,the development of offshore fishing industry in Taiwan is more an more dificult with the increasing of the cost of fishing and the shortage of labor.The development of cross-Straits fisheries are closely related and in a complementary situation according to the analysis above.Therefore,it is certain for mainland and Taiwan to cooperate with each other in order to create a double win situation.Cross-Straits cooperation in of fishery law enforcement is the foundation and security of the comprehensive copperation of fishery both in mainland an Taiwan.Fishery law enforcement is carried out to be an important means in supervise and manage fishing activities at sea.lt is a significant power to support to build a modern fishing.The cooperation of cross-Strait in fishery law enforcement can improve the level of ecological security by inspecting activities at port and sea,carrying out fishing off and closed fishing institutions,investigating illegal fishing and pollution of fishing waters and cases like this.lt can maintin a normal state in fishery production by resolving fishing disputes and conflicts and handling emergencies properly.lt also can protect the legal right of fisherman in both side by investigating and punishing all kinds of illegal activities.It shows that the cooperation of cross-Straits in fishery law enforcement is significant to development of fisheries in both sides.However,by overviewing the present status of cooperation of fishery law enforcement,it has to solve some problems in order to establish a cooperation mechanism of cross-Straits in fishery enforcement under an overall objective.As there are some overlapped waters between mainland and Taiwan,fishing disputes occurred sometimes.However,law-enforcing departments of fishery on both sides exist some contentions on how to solve these disputes.The reason of this promblem is that there has not a uniform standard and basis of law enforcement of fishery on both sides's fishery departments.In order to solve the promblems that have mentioned above,we need to fully study the present status of cooperation in cross-Straits of fishery law enforcemen,propose a pratical solutions according to long-standing experience.Only in this way can we establish a perfect cooperation mechanism of cross-Straits in fishery law enforcement,enforce the cooperation between cross-Straits in a wide range,promote the development of fishery economy and maintain the interests of the fishermen on both sides.
