In recent years, Doctor-patient relationship has been in a state of tension and medical disputes have been getting more and more in our country, because of the disadvantages of the health care system, as well as the strengthening of legal awareness of citizens. However, as the most important traditional solution in our country, the deficiency of litigation is obvious. The characteristics of specialization and ordinary tendency makes the court can't undertake the great pressure from more and more medical disputes and it also caused the wasting of lawsuit resources and action delay. Distrust initiated from the different position between doctors and patients make the Doctor-patient relationship become more and more strain. Enhance, solving the medical disputes rapidly, fairly and efficiently and maintaining the harmonious doctor-patient relationship is not only the wishes of doctors and patients, but also the very important subject we have to study.Due to the special characteristics of simple, fast and economical, ADR is widely used all over the world after the sixties of the twentieth century. It has drawn increasing attention and has become a major instrument to solve the civil disputes by many countries. Given the present situation in China, the author thinks that it is an efficient and effective way to solve the medical disputes.Research purposes:This article exert the basic principles of ADR, according to real condition in our country, the result of comparative study and case analysis and the investigation of domestic current situation, gives the policy advice, aims at taking MCH field as experimental unit to try out the ADR and construct the unit of organic connection of conciliation, mediation, arbitration and administrative adjudication as the supplement to standard the medical management and promote the steadily development of health cause.1. Research method:1. Theoretical reconstructionThe multifarious complaints which were made by the multi-relations among the modern social bodies lead to different ways of solving complaints. The single action monopolized by the country is not more and more in accordance with needs of the modern times. The reconstruction is beneficial to release the strained relations between doctors and patients and the construction of harmonious society.2. Data analysisBy using the retrospective investigation method, we investigated the medical stuff of 8 third grade first class hospitals in Changchun City. According to investigation results we demonstrate the feasibility and necessity, and take it as the basis to put forward the construction method of ADR.Conclusion and countermeasure:1. Through the analysis of recent material, we demonstrated the situation of medical disputes in MCH and confirmed that the incidence of medical disputes is the highest in health care field.2. The result of investigation display that most disputes are solved by reconciliation and conciliation, these methods were accepting by broad messes. 3. Combining the theory with the practice, we put forward the conception to construct the system of ADR in MCH, as the basis for its application in the whole medicine and hygiene fields.
