| China's new rural cooperative medical care has achieved great success, since the implementation since 2003. To a certain extent, It has eased the farmer's problem of "a doctor is difficult and expensive" and brought them masses of tangible benefits. It has curbed excessive growth in health costs, reduced the phenomenon of "drag minor ailments, ill carry". Rural health resources have been fully utilized in some sense, the system also received the support of more peasants. But there are some aspects of the problem in the new rural cooperative fund raising, using, and supervision,such as, funding is hard to rise, the use of the fund is not reasonable, the supervision of the fund is not enough and other issues; the urban and rural medical service reimbursement procedures are very complicated and there are a great deal of inconvenience to farmers; legal responsibility of the relevant provisions is absent; legislation is not uniform in China. These issues directly related to the sustainability and development of new rural cooperative health.The article analys the problems of the New Rural Cooperative medical care development of China in legal perspective. The paper points out the problems of fund raising, using, monitoring of the new rural cooperative medical care. Funding sources must be opened in using for China's new rural cooperative medical care to develope sustainablely, to increase supervision and simplify reimbursement procedures in the process of using the funds. The paper describes the legal responsibility of the new rural cooperative tripartite and mainly through the legislative status of the new rural cooperative medical care. For sustained and steady development of new rural cooperative medical care, it must be practical for the protection of the law. Therefore, it is meaningful to formulate a single set law of the new rural cooperative medical care to the development of the new rural cooperative medical care in the long term. |
