In the methodology, this article is one kind of legal cultural explanation to the Chinese modern literature. Through the research between literature and law, I have excavated and explained one kind of rich characteristic Chinese modern literature phenomenon–Non-lawsuit. So-called Non-lawsuit phenomenon of the Chinese modern literature, in certain texts of Chinese modern literature refers to one of the phenomena, which is those people who are the first floor populace result the conflicts and the disputes being lawsuit significance not through the national law, but through all sorts of non-law method, such as settling a matter privately, even using violence and the illegal punishment and so on, or through folk organizations to solve. This article explains it on the foundation of the tracing back varies production of Non-lawsuit phenomenon in the Chinese modern literature, and finally discusses the objectively multiple embodiment of it. This elaborate process aims at a crucial question that is inspecting the value and the limitation of writing brought out by the subject of critique of nationality in the Non-lawsuit narration of the enlightenment words. I hope it is a concrete and a practical channel to re-understand, and furthermore we can get a new viewpoint to reflect that subject.Besides the showing of research technique, research value and significance, Introduction emphasizes on explaining the connotation of Non-lawsuit as traditional legal culture concept. Because it comes from varies foundations, it is impossible to simply evaluate it. In order to give prominence to non-ideological production of Non-lawsuit culture, I have extracted twofold meanings mutually uniting but independent.
