This article expands the observation and the elaboration from "the non-idealism" and"the idealism" two aspects in Han Fei's thought. First, Han Fei opposed the Confucianidealism, because the Confucianism carried on the moral judgment and the presupposed value.Han Fei's thought therefore distinctively demonstrated "the non-idealism" characteristic. TheConfucian intrinsic mental theory and the supposed moral ideal had played the positive role inhistory, but excessive emphasis actually caused the Utopian chase and relative neglection ofreal world outside the will of people. When in the face of the benefit conflict which wasproduced by time vicissitude, the idealized human nature and the society expectation can notsolute the realistic problems, and these, however, became the beneficial soil that exactlyexpedited Han Fei's rational and practical spirit. Han Fei's non-idealistic theory constructionwas for the government that using law to replace the ethics politics, emphasizing the uniquepolitical function,and avoiding the ethics or the moral disturbing politics as best as he can. Second, Hanfei Zi held the loyal to the country and people from beginning to the end. Hetook the emperor as the national interest representative. Moreover, the Legalists were at theweak position in political life, which cause Han Fei naturally put all his wish on the emperorand held impractical expectation for the emperor to guard the law, so Hanfei Zi's thought fellinto "the idealism" difficulty either. This was inevitable contradiction in Hanfei Zi's thought. Third, We must give up the bad aspects in his thought ,and at the same time, take the factas the model that Japanese circle of thinkers converted to the Legalist's basic principles andmade the preparation for the Japanese morden transformation. Maybe we should reconsiderHan Fei's destiny in our own country and emphasize the beneficial factors in his thoughtwhich is helpful for our country's modernity enlightening or the modern development process. Writing this article is about to clean up the ill intellection during studying Hanfei Zi.Then we can form the reasonable regard for Han Fei attacking the Confucian moral, anddiligently return the real content back to him, so that we can objectively comprehend thereasonable factors in Han Fei's thought, neither accepting the face of him nor excessivelyblaming him only because of his inevitable time and historical limitation. Today thetraditional resource get increasingly recognition, thinking over Han Fei's practical and rational"non-idealism" as well as his "idealism" contradiction can adequately understand the goodand bad aspects in his thought.
