Research Of Imprisonment In Han Dynasty

Imprisonment, as a punishment, originated in Qing Dynasty. It turned out to be lawful and adequate in Han Dynasty. It had had great impact on the following dynasties. This paper is based on the former studies. That the origin, the crime, the prison term, the target, the relief and the influence of imprisonment in Han Dynasty are researched.Imprisonment, being an important penalty to strengthen the administration of officials and keep the emperor-centered state's ruling order, had positive effect on detering crime and punishing mandarinate's offence. The material in this paper is presented in three parts. Part one provides the origin and the target of imprisonment. At the beginning of Han Dynasty, imprisonment had already become a penalty. The targets are mainly businessmen and mandarinate. It's also a punishment to go with the selecting and punishing system. If mandarinate violated the criminal law related to imprisonment, they would be imprisoned according to law.
