| This paper mainly studies on several scholars of etiquette and legislation between the Wei and Jin Dynasties, such as Jia-chong, Xun-xu, Xun-yi, Du-yu, Fu-xuan, Zheng-chong, He-zeng and so on, from which we try to define the School of etiquette and legislation and figure out the connection between their sociopolitical theory and Jin-lv.School of etiquette and legislation was a group of scholar-bureaucrat only appeared during the end of the Wei Dynasty and the beginning of the Jin Dynasty. During Jian-an period,there are two groups of scholar-bureaucrat: School of Confucians and School of legalists. These two groups combated with each other and learnt from each other too. What School of Confucians learnt from School of legalists are how to deal with concrete matters relating to work , flexibility etc. At the same time, School of legalists began to center on Confucianism. The differences between them became less. Wang-su, a Confucian, tried to use "etiquette" to coordinate these two groups. He insisted on that "etiquette" must be the fundamental principle of legislation. Thus theses two groups combined into School of etiquette and legislation. This new group used temporization both in politics and their lives. They emphasized that etiquette and legislation should be both used in governance.Sociopolitical theory of this group had three important characteristicsrpraising Confucianism highly, temporization. practice approach. They insisted on that "etiquette" must be the fundamental principle of legislation.In politic practice, they claimed that etiquette and legislation should be used one of them according to different cases. Although they praised Confucianism highly, they were not idealist. Confucianism and ethic were governance resort to them.Their theory about etiquette and legislation influenced on Jin-lv profoundly, especially on the confucianization of Jin-lv. Eight considerations, married daughter not to be executed for being related to an offender, conviction according to five classes of mourning clothing in feudal China were established in the Wei Dynasty. All of them were inherited by Jin-lv which attribute to School of etiquette and legislation. School of etiquette and legislation took part in drafting Jin-lv, they also dissimilated and breached the confucianization of Jin-lv. Du-yu's comments on Jin-lv had the same force as Jin-lv. In ancient China, Jin-lv first time distinguished law(律) and order(令) which was Du Yu advocated. The expression of Jin-lv was concise and precise which was Du Yu's idea. |
