Research On Legal System Of Hypotheca Realization

The realization system of hypotheca is one of the most important parts of the legal system of hypotheca. The existing realization system of hypotheca is comparatively weak and feeble,much less enough to meet the demand of economy and practice. Therefore,this paper attempts to make a profound research on the realization system of hypotheca from the perspective of narrow sense. By the means of comparison,historic analysis and economic analysis,this thesis renders a comprehensive analysis of the realization of hypotheca in respect of its prerequisites,concrete ways such as auction,sales and foreclosure,and its current situation. Furthermore,a few constructive recommendation to improve the existing system are put forward in order to promote the establishment of a strict and highly- efficient realization system of hypotheca.
