A Study On The Related Problems In The Contract Of Sale Of Goods And The Contract Of Carriage Of Goods By Sea

The domestic scholars of maritime law carry on little study on the related problems in the contract of sale of goods and the contract of carriage of goods by sea.On the basis of the theory of law science in our country, legislation of bills of lading in common laws system and domestic and foreign judicial acts, this paper makes a primary inquiry into this field.The article expounds the contents concerned with carriage in the contract of sale of goods, the contents concerned with sale of goods in the contract of carriage of goods by sea, the relationship between the exporter and the carrier, the relationship between the importer and the carrier, the internal relations between the claims under bills of lading and the contract of sale of goods. In the end, the author makes some constructive suggestions to the linkup of these two contracts.The author hopes the paper will be helpful for those who are keen on this subject to carry on further study.
