The Standard Of National Treatment To Foreign Investment In China

With the speeding up of joining in WTO , more and more foreign capitals will be pouring in our country. The treatment to foreign investment is of great importance in international investment and it's also a key problem in international investment law. The Standard of National Treatment(SNT) especially attracts people's attention.This paper discusses the Standard of National Treatment to foreign investment from the following aspects: First, it introduces the legal meaning and the applicable scope of the SNT in order to analyse it's basic content, and it demonstrates that the SNT is a standard of forbidding discrimination between internal country and foreign country, compared with the just treatment and most-favored-nation treatment. Second, by means of the specific analysis about the specific stipulation in WTO, it demonstrates the general principles of the SNT between developed countries and developed countries, developed countries and developing countries, developing countries and developing countries, in order to provide reference to perfect the SNT in our country. Thirdly, in accordance with the stipulation in internal law and bilateral investments in our country, it illustrates the existing status and existing problems of the SNT, and puts forward some superficial suggestions to perfect SNT in our country from legal point.
