Researches About The Legal Issues Of The Finances Under Letter Of Credit

This thesis researches the legal issues correlated to the finance under letter of credits, and get the opinions and advices about our financial and judicial practices and legislative works by the basic theories and means of law combined with the financial and judicial practice. There five parts in this thesis:Part A. Introduce the development of letter of credit, the definitions of letter of credit, the types of letter of credit, the parties of letter of credit, the legal properties of letter of credit, the characters of the transaction of letter of credit, and the source of law about letter of credit.Part B. introduce the types of the financial under letter of credit: pacing loan, export negotiation, draft discount under export letter of credit; quota of issuing letter of credit,, trust receipt, import trust receipt loan, guarantee for picking up goods under import letter of credit; the finance under standby letter of credit.Part C. the keystone of the thesis, researches the important legal issues about the finance under letter of credit, stresses the legal properties of export negotiation, trust receipt and import trust loan, the force of the accept telex, the "without recourse" article, the relations among the parties of trust receipt, and put forward several solving means aim at some error transactions.Part D. researches the fraud on the finances of letter of credit, means of the frauds, put forward suggestions to prevent and reduce the frauds.Part E. researches affection of the E-commerces to the finances, and put forward my suggestions through analyzing the rules of law in existence.
