Study On Court's Action In International Commercial Arbitration

The article put forward the affinity between court that has compellent power and international commercial arbitration directly because arbitration that can settle dispute by non-suit is playing important role. The author put forward her own sharp-cut opinion though court has two actions, namely supervise and support in form they are same to accelerate the development of international commercial arbitration in essential. This is the article's argumentation.The article then sum up the current that court more and more support international commercial arbitration. According the historical development of court's action and related international pact and related law of develped country the article studyed five actions that have affinities to my country. To every action the article studyed the related development current in the world firstly. Then it analyzed the related questions in my country. At last it put forward the resolvent of these questions.During demonstrated these five actions the article the author gave her own advice and point of question. For example the conservatory measures. The article advised adopt this method that the arbitration tribunal give their decision then the court carry out this decision. This method can overcome the malpractice that the court or the arbitration tribunal decide and carry out free hand.Lastly, the article repeated the current that court should support international commercial arbitration by discussed court's five actions in international commercial arbitration.
