Maritime Law Comparative Study

Under the driving of globalization of economy and trade, international maritime legislation is also developing a trend of globalization. To view the achievement, ship tort legislation falls behind contract legislation from beginning to end. Different country's maritime laws appear considerable difference on ship tort. There are also great difference in understanding the basic concept and basic theory of ship tort law, on the contrary, there are few studies on the theory of ship tort law. I have to express regret over the matter.The author studies the basic concept and basic theory of ship tort law mainly with the methods of comparative analysis, standard analysis, positivist analysis and combine national law with international law.This paper makes ship tort legal system comparative study as subject, makes different country's ship tort law as main studying object, through the analysis on basic legal concept of ship tort law, the value trending of ship tort law, different country's ship tort law, at the same time, on the basis of the achievement obtained by the senior maritime law scholars, put forward that ship tort law should regard fair as its final value trending, realize the true legal fair, abolish every unreasonable system of dissolution of responsibility, look forward to future of ship tort law, advance that globalization is ship tort law's inexorable trend, put forward a proposal of our country's ship tort law legislation.
