Study On The Legal System Of Right Of Mortgage With Respect To Ship

Ship mortgage, which falls into the scope of ship securities, plays an important role in the shipping finance. Taking the ship mortgage system as its research objective, this article attempts to discuss into every aspect of the system, including the acquisition of ship mortgage, its validity, realization and extinction. Each part of the article, basing on the current ship mortgage system under Chinese law and the theoretical mortgage system in civil law, focuses on the existing omission or ambiguity, and attempt to several points of view on some disputes and the newly-arising problems.
