On The Procedural Right Of Private Party In The Administrative Process

As the right which private party enjoys in the administrative process,the procedural right includes the right of participation,the right of pleading,the right of challenge to the jurors and the right to know and so on. The procedural right helps to realize the substantive right of private party and corresponds to the administrative body's procedural obligation. Based on the theory of power equalization,public participation,legal defense,principle of natural justice and due process of law,the procedural right gives full play to raise efficiency,defend democracy and prevent the alienation of procedure. Looking at the experiences of Western countries and the existing features of Chinese legislation,the thesis discusses some fundamental aspects about how to establish and enforce the system of procedural right of private party in the administrative process.
