To protect the right and interest bestowed by law of the citizens who can't afford the law service fee because of their poor economic status, a system is established in our country that aims to reduce and remit their fee. This judicial relief is called legal aid. Passing through the stage of "legal aid for the sake of mercy" and that of "legal aid for the sake of right", legal aid, first appearing in England, has a history of more than 500 years. The institution of legal aid can offset the insurmountable defects of judicial injustice brought by the compensated law service mechanism and safeguard the human right bestowed by the substantive law from the standpoints of the procedural law, thus it is one of the efficient measured that ensure a fair and just ruling of law. Its institution is one of the symbols that a nation pays respect to and attaches importance to human rights. At present it is necessary and feasible to perfect the institution of legal aid in our country. It is both a judicial reform and an institutional innovation, and in addition, it is the requirement of executing the strategy of rule by law. Though now legal aid in China is immature, the institution of legal aid will be rapidly set up with putting forward of the perfecting the legal aid system. The paper makes an initial discuss on the perfection of the system in our country through the way of analytical investigation and comparative study. The paper has three chapters. The main contents are as follows: (1) Expound on the general theories and modes about legal aid; (2) Argumentationson the inevitability and feasibility of the perfection of the institution of legal aid in China; (3) Suggests for reference on the perfection of institution of legal aid in our country.
