Research On The International Protection For Human Rights

The issue concerning the Protection for Human Rights has not been given genuine attention by international society and involved in the international law field until the World War II. Human being, at the expense of experiencing twice extremely crucial war, made such wisdom choice through profoundly self-questioning and history summarizing. With international society paying great attention on human rights, relevant legislation, and increasing production of law, one new branch from International Law, namely International Law of Human Right, has been formed and mainly research legal issue involved in International Human Rights.But problem in Human Rights could not been completely resolved as brought into jurisdiction of the international field. On the contrary, in practice, struggles surrounding the protection of Human Rights in international society are still very intense. While in theory area, the argument in respect of Human Rights is unable to decide which is right.This thesis outspreads issue on the International Protection for Human Rights, including the statue quo of legislation, main content, protection organization and so on. Besides, author emphasizes researching on relationship between International Protection for Human Right and National Sovereignty, relationship between International Protection for Human Right and Principle for No Intervening Interior. Through careful analysis and research, the author hold that: in nowadays society, the issue on Human Rights still belongs to extent of internal jurisdiction; only under effective criterion and control can guarantee the unilateral humanitarian intervene would not be abused. Principle for National Sovereignty and No Intervening Interior are the fundamental basis to possess Human Rights.By sufficiently respecting above two principles, we could promote the international protection of human rights and ultimately fulfil the goal for Human Right Protection.
