Research On Cybercrime Issue

Cybercrime is unavoidable by-products of the popularization of Internet. Meanwhile,as Internet penetrating more and more deeply global economy and social living,cybercrimes grow broader and more complicated,become one of the focal points arouse broad attention from home and abroad.The concept of "Cybercrime" differs from "Computer Crime",its content could be divided into two categories:Cybercrime in narrow sense (i.e.,crimes for computer network) and cybercrime in broad sense (i.e.,crimes by computer network),the former is basically consistent in the crime features of several crimes in present criminal law of China,the main problem is defining and resisting of cracker behavior. As for cybercrime in broad sense,in fact,it is combination of some traditional crimes and internet instead of a category' of crime,including cyber theft,cyber cheat,cyber racketeering and threatening,cyber smuggle,cyber insulting,slandering and rumor mongering,etc.,The resistance of cybercrime is a brand new task for circle of justice theory and practice home and abroad,the most difficult areas focus on jurisdiction,cyber evidence and investigation measures,etc.. meanwhile,it involved complicated law-sociology problem.Today,international community is making great efforts to resist cybercrime. These efforts focused on international justice cooperation in initial stage. From the point of long-term,it is certainly necessary to constitute international unanimousregulation. The m6st attractive progress is the draft of "the Convention on Cybercrime" drawn by the Council of Europe. It attempted to define cybercrime clearly in fields of both entity and procedure law,and put forward a series of measure of resistance. This convention offered a valuable frame for resolve cybercrime problem effectively.
