Unemployment is an inevitable result of the modern market economy, but it greatly affects the development of social economy and stability of social order. To establish and improve the system, therefore, is the important guarantee for a country's lasting stability and durable peace. This paper starts with the basic theory of unemployment insurance system, reviews and comments on the unemployment insurance systems at home and abroad, and it presents the countermeasures to improve it.The paper includes four sections. Section 1 mainly introduces the basic theory of unemployment insurance system including: definitions and types of unemployment and unemployment insurance; definition, adjusting objects and origins of unemployment insurance law, and so on. It argues that the future choice of unemployment insurance system should be like this: insurance is raised through multi-channels, unemployment is dually guaranteed, unemployment insurance expenses are jointly paid by three parties (enterprise, individual and state), and passive insurance and active insurance are integrated.Section 2 reveals the theoretical foundation of unemployment insurance system, reviews its establishment and development in foreign countries, and lays emphasis on investigating its developing process in China. Our country's unemployment insurance system has mainly experienced three stages: Stage 1 (from 1986 to 1992) is the establishment and implementation period. Stage 2 (from 1993 to 1998) is the normal operation period, when Regulations on Waiting-for-a-job Insurance for Staff at State-owned Enterprises are enacted by the State Council. Stage 3 (from 1999 till now) is a new developing period, when Byelaw of Unemployment Insurance is enacted.Section 3 is the difficult part of the whole paper. By analyzing unemployment insurance systems in foreign countries, it is found that the most countries in the world adopt compulsory system. They have many good experiences which we can learn from such as the regulations and laws in the fields of fund sources, enjoying conditions, unemployment subsidies and its expecting time, time restriction on successively raising unemployment subsidies, management system and legislation of connecting and matching unemployment insurance and reemployment process. Likewise, many lesson should be drawn, for example, social insurance and guarantee capital's depends much on state taxation, welfare standard is, and so on. This paper further evaluates and analyzes the existing unemployment insurance system in China, and conclusions are drawn as follows: since the promulgation of Byelaw of Unemployment Insurance by the State Council on January 22, 1999, the system has been greatly improved and perfected in both the basic concepts and specific legal system, and it links lines with internationalconvention. However, some parts fail to meet the needs of the market economy, the following deficiencies should be improved: in the level of value, the inaccurate function orientation and the principle of fairness being violated are two deficiencies in the existing unemployment insurance system. In the level of legislation skills, it lacks a clear level and mutually coordinating comprehensive legal system. And legislation level and legal effectiveness are lower, and legal duty is not perfect enough. There is no qualification auditing organization and the qualification auditing is not strict, the regulations on qualification of gaining unemployment insurance are vague or not made at all. The level of raising unemployment insurance fund and its treatment are lower, its calculating method and granting are unreasonable, which does not link up the other systems. The measures of promoting reemployment are nearly nothing. The management of unemployment insurance lacks oneness and authority. The unemployment insurance fund with more charge and less expense is unreasonable.
