The land concentration to the more specialized farming household and agribusiness satisfied the needs of appropriate land scale operations and improved the international competence of agriculture, but in a few areas the circulation is still spontaneous and in chaos .the peasants' contracted land rights to use have been often encroached .How to make the circulation of rural Land right to use in a right and orderly direction and set up a circulation system to be truly "volunteer, by law, paid " is a urgent problem to be solved.The paper has studied the domestic and international research achievements of the problem and present the intension of circulation of land right to use. The study has analyzed the emerging background of the problem and its necessity. It points out the circulation of land right to us has to meet the following needs the establishment and perfection of markets rural production factors, the related low utilization ration of land resources, the adjustment of rural economic structure, the shift of the agricultural workforces, the improvement of international competence of agriculture, the optimal recombination of resources, and the enhancement and stability of farming family contracted rights. According to a large amount of documents and many investigations, the current situation and characteristics of the operation is analyzed from the cause analysisof not so good circulation of land right to use although the action has been promoted for a few years, it points out the problem and difficulty of the action and analyses if from the points of institutional improvement, thinking and ideas, working style, external environment etc. According to new "Rural Land Contract Law" the trend related to the circulation of land right to use has been analyzed. On this basis, the thought to perfect the action has been presented. The agricultural land system needs further perfection, the government strengthens management, provides better services, perfect the policy, makes the principle, normalize the circulation operation, establishes the circulation market of land right to use and improves the external environment of land market development .so that the circulation of rural right to use develop in an better expectation.
