Initial Study On The Security Institution And The Development Trend Of Our Nation Current Constitution

The constitution consists of the citizen rights, the nation power and the security institution, among which the security institution of the constitution is the key. With the development of our nation constitution, the research on the security institution of the constitution has been put on the agenda. But it has a lot of problems in its theory and practice, not only because the research of constitutionalism was later in our state but also in the beginning we proposed to make a copy. For example, it mixes up the security institution of the constitution with the constitution supervision, dwindles the scope of the security institution, compartmentalizes the purview unreasonably, the rule of law conflicts with the ruling means of the ministerial party, the main body of the security institution is not clear, citizens lack the constitutional consciousness and so on. If we can't resolve these problems properly and improve the security institution of our nation constitution primly, it will endanger the development of the constitution much less the security of citizens' rights of our nation. Therefore large as the scope of it, I choose it as the title. And I try to bring forward some personal advices and assumptions, such as the new cognition about the security institution of the constitution, putting forward macroscopical ways of the research, advocating the separation of the legislative power from the legislative supervision power and so on.The text consists of three parts. At chapter one viz. the theory boundary of the security institution of the constitution, I analyze the difference between the security institution of the constitution and the constitution supervision as well as the object and the ways of the security institution of the constitution, which establish the theory base of the research. At the chapter two viz. the analysis about the security institution of our nation current constitution, I analyze mostly the status in quo and the existent problems as viewed from the base of the constitutionalism, the guarantee of the party, the guarantee of the system and the guarantee of the law. At chapter three viz. the development trend of the security institution of our nation constitution, I put forward some advice and imaginations of my own about the problems that have been mentioned at the chapter two.
