Reform Of Civil Procedural: From Selection Of Judicial Mode To Improvement Of Legal Procedure

The thesis is composed of three parts.Part one is introduction. In this part, the author points out, in order to make the reform of civil procedural to advance successfully, we must see clearly and overall in the situation of the reform of civil procedural, and grasp it's future correctly. The author try to throb with the pulse of the reform of civil procedural in our country, and point out the direction of reform in civil procedural by historic investigation and comparative method.The second part composed of four chapters . Chapter one point the content and goal of civil procedural, and the difference between the reform of civil procedural and the reform of judicial mode. Chapter two points out the trends of the reform of civil procedural is adjusting the legal procedure. Chapter two observes the historical judicial mode of civil procedural, and inferences that our country has finished the selection of the judicial mode. Chapter four enlists the concrete course of action of adjusting legal procedure in our country today and the failure in the theory and the practice, proposes the content of reform in legal procedure and correspondent guarantee measures in the practice .Part three is the concluding remarks . It points out that the reform of civil procedural is facing many problem. Although the problem can not be solved only by selection of judicial mode and the improvement of legal procedure, but the judicial mode and legal procedure have become the first problem in the construction of legal institution. The author calls on making great efforts on the theory and practice in the reform of procedural by the jurists and the judges .
