Study On Legal Issues Concerning Multimodal Transport Of Goods

Multimodal transport becomes more and more important economically. From the very beginning, the law of the multimodal transport is eager for international uniformity, however no mandatory international convention has been achieved till now and the development of the international multimodal transport is impeded. China multimodal transport law also appears its weakness before the need of the development of the transport industry and should be revised and improved. The present chaos of the international and Chinese multimodal transport law need to be clarified. On the basis of the principle of civil and commercial law and the law of transportation, by the way of comparatively researching the similar legal issues of different countries and districts, and according to relevant theories of the law and economics, this dissertation studies some important legal issues concerning multimodal transport. It clarifies the concepts of the multimodal transport, analyses the legal status and nexus of the multimodal transport participants, and the legal nexus between them and the cargo party. The dissertation mainly studies the problems of the liability system of the multimodal transport operator and the uniformity of liability system of the international multimodal transport operator. The dissertation also designs the primary legal framework of liability system of multimodal transport operator of China and hope to be beneficial to the study of the international and internal multimodal transport law.
