The international law is an important instrument of international combat and cooperation, keeping the world' s peace and establishing the new political and economical order of the world. Generally speaking, the current system of international law is in favor of the world' s peace and economic development. However, we should note that, due to the forming conditions and some of the international political factors, the system holds some unreasonable elements, which needs further improvement and perfection. In view of the new situations and new problems emerging in the development of the international society, a new reasonable system of order is needed. Especially, after the NATO bombed the sovereignty of Yugoslavia, the Chinese embassy in Yugoslavia, the "9.11" terrorist accident and a consequence of events, we feel that the international law is seriously confronted with a great challenge.This paper first makes a study of the current situation of the international law and also the prospect of it. Then this paper systematically analyzes, taking the new situation and the new problem arising after China' s opening up into consideration, the proper policy that China should adopt to face the challenge that confronts the international law in the 21st century.This paper employs the historical analytic way to review the research methods of international law in the 20th century, and also use it to predict the trend of international law' s development and China' s strategy to' cope with it. Using the way of comparative analysis, this paper makes a comparative study of the scholars' view of different schools of international law, points out several conundrum left from the 20th century, predicts the trend of development of the International law in the 21st century and explains thetrategy that China should take.
