Research On International Judicial In Criminal Matters

The International Judicial Assistance in Criminal Matters(IJACM), which is the most important form in the international judicial cooperation on criminal matters, has played a more obvious role on cracking down international and transnational crimination day by day, and therefore, it is taken seriously by the countries throughout the world. Since the middle of 1980th, china has signed treaties on judicial assistance in criminal matters and extradition treaties with several countries. Then, the publication and implement of the Extradition Law in November 2000 symbolizes that the system of U ACM in China has taken a standard stride forward. However, to some extent, there are still some problems existing in the present situation of IJACM in China . This essay starts with the general theories of IJACM, seriously analyses and studies on the present situation and the existing problems of IJACM, finds out the insufficiencies of our legislation and the treaties singed with foreign countries, makes several suggestions on establishing and amplifying the system of IJACM in China.
